Judge calls California’s medical misinformation law “nonsense,” blocks it

A federal judge questioned the new  law that penalizes doctors for sharing COVID-19 “misinformation.”

The new law, which came into effect on January 1 this year, prohibits doctors from spreading what the state deems to be misinformation to patients, or risk being penalized for “unprofessional conduct,” which could result in their licenses being revoked.

Here’s a summary of the case so far if you’re not up to date.

The law has been challenged through separate lawsuits filed by two organizations and a group of doctors on the grounds of  violations. They filed a motion at the US District Court of Sacramento to hold the law until the cases are concluded.

In a hearing, Senior Judge William Shubb described the law’s definition of misinformation as “nonsense.”

“Because AB 2098 [the misinformation law] implicates [plaintiff’s] First Amendment right to receive information, she has standing,” the court wrote.

“Vague statutes are particularly objectionable when they involve sensitive areas of First Amendment freedoms because they operate to inhibit the exercise of those freedoms,” the court added, referring to a 2001 case, California Teachers Association v. State Board of Education.

“When the challenged law implicates First Amendment rights, a facial challenge based on vagueness is appropriate.”

The court granted the plaintiffs a hearing to challenge the law and blocked the enforcement of the law until the case is decided.

The law defines misinformation as “false information that is contradicted by contemporary scientific consensus contrary to the standard of care.”

Shubb noted that “standard of care” is not a new principle, but argued, “contemporary scientific consensus” is.

According to Deputy Attorney General Kristin Liska, who is representing Gov. Gavin Newsom, a medical professional has to violate all three aspects of the definition of misinformation for punishment to be applicable; share misinformation, contradict scientific consensus, and go against the standard of care.

However, she refused to give examples of statements that would fit the definition, saying that it would depend on the circumstances.

Shubb then asked how she expects medical professionals to know what would violate the law.

    Here is what would violate the law. “Covid” is a fraud. The fraud was started using computer modelling. Lockdowns have destroyed thousands of lives and businesses. The vaxxes did not and do not work, they cannot prevent infection, transmission, illness or death. The vaxxes have now been proven to kill people. Immune system are damaged by the vaxxes. Heart disease has been stimulated by the vaxxes and young healthy athletes are dropping dead and the vaxxes are the problem. All those who promoted and forced the vaxxes should be charged with crimes against humanity and hanged when found guilty. Those are just some of the things that it would be against the law to say and all can be proven to be true.

      I have written before on this site and others how I nearly died of a blood clot in my right leg in April of 2020. Based on my research of mRNA technology I was not getting anywhere near the Covid jab. At my next regularly scheduled visit with my personal physician I shared with him how didn’t want the jab because of my clot history. He completely agreed and said I shouldn’t take it. In the almost 3 years since then he has never brought up the subject of the jab. And neither have I.

      It makes me wonder that if we both lived in California would he be subject to losing his medical license because he felt I shouldn’t take a jab that had shown blood clotting to be a side effect knowing full well I nearly died of a clot?

      This is so scary that a doctor couldn’t fit his medical advice to a patient because the state didn’t approve. This cannot be allowed to stand.

      Not one person or organization has shown a c19 virus isolate.

      Many have asked the pharma & .gov to provide isolates so they can verify Kochs Postulates. We no jave it, is the response.

      And, of course pharma tells us, their Patented Bioweapon Injections aren’t based on a c19 Virus…nor can they immunize anyone or keep them from spreading a disease…of buffer symptoms or prevent deaths….

      So why does the .gov and media beat the drum constantly, “Safe & Effective”….when recent history and 20+;years of killing all test animals attests…it kills all humans too.

            On the issue of Kochs Postulates and viruses I give credence to esteemed pathologist Dr Arne Burckardt and Dr Sucharit Bhakdi. Both are age plus 75 years and are not reliant on big pharma funding, directly or indirectly.

            I am unable to reference the following. But it really doesn’t matter forI my question to you is: Do you agree with the following?

            “While there is no magic solution that will promise you a healthy, working immune system, eating the right foods (a balanced diet, plenty of water) and moving your body regularly will ensure your immune system is working to its best ability. Viruses, germs and illness will always be a part of our world, but by living a healthy lifestyle and eating the right foods, we are helping our immune system, building the right “terrain” and creating the defence against potential threats.” 

            If you agree, what are these “potential threats”? Are these threats not viruses, germs which cause illnesses?

            Nonbacterial contagions have been around for time immemorial, long before vaccines existed.
            Whilst terrain theory has some merit I have never seen a credible alternate explanation for viral contagion that manifests with specific illness and disease characteristics.
            Of course, the electron microscope reveals a lot about intracellular activity as referenced by that really cool dude Moffin above. 🙂
            So aspects around train theory appear to be in a dark tunnel. Hating big pharma should not feed fantasy.

            I took another read of Lanka’s writing. This caught my attention.

            What are these “spores of all kinds”? Duh!

            Another thing caught my attention.

      This sounds like a reasonable report which includes the list:
      Miscarriages – 279 percent increase,
      Hypertension (high blood pressure): 2,281 percent increase,
      Diseases of the nervous system: 1,048 percent increase, and
      Cancer: 296 percent increase.
