EPA Exempts Data Center Power Plants From ‘Acid Rain’ Controls

The Environmental Protection Agency under President Donald Trump is clearing pollution-control barriers around America’s expanding AI infrastructure as researchers report massive nitrogen oxide emissions from an AI power plant and EPA documents identify potentially lethal hazards from newly approved semiconductor chemicals

The evidence comes from EPA’s own July guidance, an August 25 satellite study, and EPA consent orders reviewed by The Guardian published Wednesday.

It raises immediate health, safety, and environmental questions:

Who will be exposed to the additional pollution and chemicals, what are the cumulative risks to nearby communities, air, and water, and why are regulatory barriers being removed before those risks are fully known?

The EPA’s move comes after President Trump announced the $500 billion “Stargate” project in January 2025 to rapidly expand artificial intelligence infrastructure across the United States.

The EPA is led by Lee Zeldin, selected by Trump in November 2024 and confirmed by the Senate with a 56–42 vote in January 2025.

EPA’s announcement states directly:

“the Clean Air Act (CAA) Acid Rain Program (ARP) does not apply to power generation facilities that are not connected to a public electricity grid.”

EPA calls these “islanded” power generation facilities and specifically says the guidance applies to facilities developed to power data centers.

Why does that matter?

EPA’s own description of the Acid Rain Program says it:

“requires major emission reductions of sulfur dioxide (SO₂) and nitrogen oxides (NOₓ), the primary precursors of acid rain.”

The program also caps sulfur dioxide emissions from covered electric-generating units and requires emissions monitoring.

EPA’s July announcement explains why the off-grid plants escape the program: because they neither sell electricity nor have required reporting to the Department of Energy, EPA concluded they are not subject to it.

If they later connect to the grid, EPA says they may become subject to the program. In other words, the distinction is regulatory, not physical.

Disconnecting a power plant from the public grid does not mean it cannot emit the pollutants EPA calls the “primary precursors of acid rain.”

Satellite Study Finds NOₓ Emissions 16 Times Expected Level

The pollution concern is not theoretical.

On Aug 23, researchers Kevin Gauld, Daniel Varon, Nicholas Balasus, and Daniel Cusworth submitted a study titled Quantifying AI data center nitrogen oxide (NOₓ) emissions from space.”

Using NASA’s TEMPO satellite, they measured emissions from the SpaceXAI Colossus 2 power plant in Southaven, Mississippi.

The researchers reported:

“emissions increased through August 2026.”

After February, they estimated average emissions of 730 ± 185 kilograms of NOₓ per hour, roughly 16 times the approximately 47 kilograms per hour they calculated would be expected under the facility’s March 2026 permit for 41 turbines operating under required pollution controls.

NOₓ is one of the pollutants EPA itself calls a “primary precursor” of acid rain, but the study does not establish that EPA’s July decision caused those emissions. It provides a real-world warning about the scale of NOₓ that can accompany power generation for massive AI facilities.

EPA Documents Flag ‘Acute Lethality’

Then came another potential hazard.

Yesterday, The Guardian reported that environmental groups had sued EPA over its approval of two photoacid-generator chemicals for semiconductor manufacturing.

The chemicals were approved for import and immediate use in U.S. facilities and appear to be PFAS “forever chemicals,” although The Guardian reported that portions of the EPA documents (including the chemicals’ identities) are redacted.

More importantly, The Guardian reviewed the EPA consent orders themselves. According to EPA language reproduced in the report, the agency identified potential risks to the public including:

“acute toxicity, genetic toxicity, and systemic, reproductive, and developmental effects”

Potential exposure routes included drinking water, contaminated groundwater, and inhalation from industrial stack releases. The EPA said:

“The risks for these endpoints were not quantified due to insufficient information on hazard.”

For workers, EPA additionally identified potential respiratory and skin irritation, eye corrosion, and “acute lethality.”

The EPA said it had “insufficient data” to assess that acute-lethality risk. The Guardian changed “acute lethality” to “sudden death.”

The documents also said EPA could not estimate the environmental hazard because it lacked sufficient information. Yet the chemicals were approved.

The Bottom Line

Three developments now converge around America’s accelerating AI buildout.

  • EPA said July 27 that certain off-grid data-center power plants are outside a federal program requiring major reductions in pollutants it calls the “primary precursors of acid rain.”
  • Researchers reported Aug 23 that an AI power plant was emitting NOₓ at roughly 16 times the level expected under its permit.
  • And The Guardian reported Aug 26, based on EPA consent orders, that EPA approved semiconductor chemicals despite identifying potential hazards including reproductive and developmental effects and “acute lethality” while acknowledging that some health and environmental risks could not be quantified.

Washington wants AI infrastructure built quickly, but who bears the health and environmental costs of that acceleration?

And why should Americans be exposed to potentially serious hazards before regulators can even quantify the risks?
