Tusk’s proposed legislation facilitates German companies to build wind farms on expropriated farmland

Legislation proposed by Poland’s new government facilitates the expansion of wind turbines in the country, it contains clauses that could make it much easier for Germans to buy Polish land.

These have been added to a bill to freeze electricity prices.

Robert Telus, a Member of Parliament (“MP”) for the outgoing ruling conservative Law and Justice Party (“PiS”) and former agriculture minister, said that the proposed legislation is dangerous for rural areas because it makes the purchase of land easier, which could, in turn, allow Germans to buy up Polish farmland and convert it into wind farms.

He said he believes that the legislative proposal is an example of Donald Tusk’s Civic Coalition (“KO”) doing the bidding of German lobbyists.

The incoming government of a coalition of pro-European parties, led by former European Council President Donald Tusk (pictured), plans to transition the country from coal to up to 70 percent of energy production from “renewable” sources by 2030.

Last year about 15 percent of Poland’s energy came from wind and solar.  Poland has one of Europe’s highest energy prices as it produces around 70 percent of its electricity from coal.  Coal has become more costly due to the cost of ‘carbon’ emissions, one of the effects of Europe’s carbon-emissions trading scheme.

A legislative proposal introduced into parliament on 30 November by MPs from Poland 2050 and KO, the new coalition government, extends the energy price freeze and includes provisions significantly loosening restrictions on the building of wind farms in Poland.

If the legislation passes, wind turbines will be able to be placed as close as 300 meters from domestic buildings. However, the proposed legislation and associated funding have been dubbed the “Windmill Scandal” by its opponents.

The proposal changes the permitted noise level for wind projects and would allow turbines to be built about 300 meters from the nearest housing, down from about 700 meters under the current rules.

It would also allow wind power closer to national parks and nature reserves.

“Without consultations, without analyses, without preparation, KO and Poland 2050 politicians want to install large turbines next to Poles’ homes,” tweeted Prime Minister Mateusz Morawiecki. “Who will lose out? The Polish people. Who will benefit? Lobbyists.”

The proposal also seeks to make wind power investments – or any renewable investment larger than 1 megawatt in installed capacity – “investments of public purpose,” which PiS says would allow for the expropriation of land owners.

Sławek Wodzyński, co-founder of the Basta Foundation which is a non-governmental organisation that monitors the media and politicians, said that the bill would allow “expropriation of private persons for the purpose of building wind power plants and other [renewable] investments, as [such] investments will be considered a public goal.”

He called the proposed change “a serious interference with property rights and citizens’ rights.”

“If you don’t like it, or if some investor, probably foreign, falls in love with your plot of land you will be able to be expropriated to put up wind turbines there,” added Sebastian Kaleta, a deputy justice minister. “The only tranche of the KPO that the European Commission has not blocked in Poland is the one for the construction of windmills.”

​Telus agrees and said that it will be helpful to German business interests, adding that this is the way Tusk’s party is thanking German lobbyists for their support during the election. This is because the legislation allows wind turbines to be placed on agricultural land, which would allow German companies to purchase this land to build wind farms.

“This is an example of EU policy feeding German interests,” Telus said. “Allowing the construction of wind farms on high-class agricultural land works to the detriment of Polish food security.”

Like Kaleta, Telus also says that the proposed legislation is connected to the payment received from Poland’s National Recovery Plan (“KPO”), funds from the European Union’s (“EU’s”) post-pandemic Recovery and Resilience Facility.

Through the Facility, the European Commission makes funds available to member states to implement reforms that make “green and digital transitions, in line with the EU’s priorities” and for the “coordination and surveillance of economic and social policies.”  But the funds come at a cost.

There are 283 KPO milestones, comprising 106 changes in law and 177 investments, that Poland must make to unlock the EU funds.  Funds will be unlocked tranche by tranche, depending on the applications and milestones.

As Kaleta said, so far only one tranche has been unlocked.

Telus believes that the KPO tranche that has been received – EUR 5 billion for wind farms – corresponds to the losses sustained by German company Siemens, a major provider of wind turbine technology.

“We received this [EUR 5 billion] funding to cover Siemens’ losses and this can be seen with the naked eye. We regret this fact, but it shows that very strong German policy is being pursued in the EU,” he said.

On Friday, 1 December, Education Minister Krzysztof Szczucki, announced that PiS had submitted a request to the prosecutor’s office and the Central Anti-Corruption Bureau “to check who is behind the bill on energy prices.”

    Food, you grow food on farm land, not wind turbines. The insanity of wind and solar has to stop.

    Would it be considered as illegal State Aid?!
    Are such EU policies/political actions a form of socialism, communism, fascism, totalitarianism, corporatism, unelected ECism (European Commission), Green Agenda 2030/2050-ism, something else or is it plain and simply just pure corruption?
    Are such terms as ‘investments for public purpose’, ‘public goal’, ‘common good’, ‘social solidarity’ etc. being used to deceive the people into accepting without much questioning what may otherwise appear to be private agendas?
    Was there a European Court decision that rendered existing and proposed wind turbines installed without an SEA (a Strategic Environmental Assessment evaluating the effects of certain Plans and Programmes on the Environment) as illegal developments?!
    Do wind turbines (at all scales) actually comply with the EU Machinery Directive?!
    Will refunds/compensation/restoration of all the carbon taxes, renewable energy government funding, renewable subsidies, damages for the destruction of conventional energy systems, damages to the environment etc. be sought if and when the whole global warming, climate change, carbon trading, net zero etc. policies are generally realised to have been one great big scam based on fraudulent science, lies and propaganda?
    Is there already an existing legal precedent set in Poland against the government appropriation/compulsory purchase of private lands and property?
    Surely with Poland’s history the people of Poland would be quick to spot any potential political scams and/or scams in general and therefore quick to nip them in the bud?
    Poland produces wonderful farm produce. Will the farmers of Poland be forced to fight to protect and keep their farms and their livelihood?
    Will they be forced to follow the lead of the Dutch farmers?
    Is Poland being used as a test bed, that is, if the Poles fall for what is being called a ‘Windmill Scandal’ then would that make it much easier to roll out further onshore windmill intensification throughout the rest of Europe?
    How is it that as more expensive, unreliable/intermittent, inefficient and generally environmentally unfriendly renewables are installed that the overall energy generating capacity and energy demand have increased yet due to cost factors most domestic users and small businesses have been forced to reduce their demand for energy?
    So to what extent have predominantly fossil fuel guzzling Data Centres, electric vehicles, battery energy storage systems and heat pumps created increased energy demands overall and at what extra cost for domestic users and small businesses?
    Is there a high correlation between the increased installation of renewables and the erosion of the market competitiveness of Europe?
